Terms of Service

Last updated: October 18, 2026

1. Definitions

These Terms of Service (the "Terms") are offered by Brooke, a business based in Switzerland (the "Company").

  • "Site": drinkbrooke.com and all of its pages, owned exclusively by the Company.
  • "Products": all products available for purchase on the Site.
  • "Seller": Brooke, operated by the Company.
  • "Customer": any individual or business purchasing Products on the Site.
  • "Consumer": any individual purchasing for personal use, outside of any trade, business or profession.

Please read these Terms carefully, and save or print a copy, before placing an order. By placing an order, you confirm that you have read and fully accept these Terms.

2. Scope of these Terms

We may update these Terms at any time by posting a new version on the Site. The Terms that apply to your order are those in effect on the day you place it. Information about our hosting provider, how we handle your data, and how the Site may be used is available in our Legal Notice, Privacy Policy and Cookie & Data Protection Policy.

The Site sells electrolyte drink mixes and related hydration products. Access to the Site is free. By ticking the box "I have read and accept the Terms of Service" at checkout, or by completing an order, you accept these Terms with the same effect as a handwritten signature.

You confirm that you are at least the age of majority in your state, province or territory, or that you have permission from a parent or legal guardian. Our electronic records are accepted as proof of your orders, unless you can prove otherwise. These Terms take precedence over any other document, such as catalogs, ads or brochures, unless we agree otherwise in writing.

3. Customer service

Our customer service team is available by email at help@drinkbrooke.com or by mail at the address in our Legal Notice. Please include your first name, last name, order number and the reason for your message. Business inquiries (partnerships, media, wholesale) are handled by email only, at help@drinkbrooke.com.

4. How to order

The Products offered are those shown on the Site. Each product description is based on information from our supplier. Photos are for illustration only and may differ slightly from the actual product because of screen settings, lighting or camera angle.

  1. Add one or more Products to your cart by clicking "Add to cart". You can review and change your cart at any time.
  2. On the Information page, enter your contact details. You can choose to receive order updates by email.
  3. On the Shipping page, choose your shipping method.
  4. On the Payment page, enter your payment details and billing address, and add a discount code if you have one.
  5. Review your full order summary, then click "Complete order".

You are responsible for any errors in your order, product choice or contact details. The sale is final once you have confirmed your order, accepted these Terms and completed payment, subject to our Refund & Return Policy. Your order date is the date we receive full payment.

5. Prices and payment

Unless stated otherwise, prices are shown in US dollars (USD). Applicable sales tax is calculated at checkout based on your shipping address. Shipping costs are shown before you pay. We may change our prices at any time, but the price shown on the day of your order is the price you pay.

We accept the payment methods shown at checkout. Payments are processed through secure third-party payment providers. We never see or store your full card details. We keep order confirmations and invoices on a reliable, durable medium, and these records are accepted as proof of transactions between us.

6. Shipping

Shipping costs and estimated delivery times are shown at checkout and in our Shipping Policy. Delivery times are estimates and may be affected by carrier delays or events outside our control (strikes, severe weather, customs checks).

Unless stated otherwise at checkout, we ship your order within 30 days of purchase. If your order is significantly delayed beyond the estimated delivery date, contact us and we will offer a replacement or a full refund.

Damaged or incomplete deliveries: check your package as soon as you receive it. If it is damaged, opened or incomplete, contact us within 7 days at help@drinkbrooke.com with photos of the package and its contents.

Package marked as delivered but not received: contact us within 7 days. We may ask you to file a claim with the carrier or post office. Once we have reviewed the case, we will do our best to make it right, including resending your order at our expense where appropriate.

Refused or returned packages: if a package is returned to us because it was refused, unclaimed or sent to an incorrect address, we will contact you. We can reship it once you have paid the new shipping cost, even if shipping was originally free.

7. Returns and refunds

Returns and refunds are covered by our Refund & Return Policy, which forms part of these Terms.

8. Health disclaimer

These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease.

Our products are food products meant to support daily hydration as part of a balanced diet. Do not exceed the recommended serving. If you are pregnant, nursing, taking medication, on a sodium- or potassium-restricted diet, or have a medical condition (including kidney or heart conditions), consult your doctor before use. Keep out of reach of children. The information on our Site is for general information only and is not medical advice.

9. Product warranty and consumer rights

We guarantee that our Products match their description and are fit for normal use on delivery. If you receive a damaged, defective or incorrect Product, contact us and we will replace it or refund you, as described in our Refund & Return Policy.

Nothing in these Terms limits any rights you have under the consumer protection laws of your state or country.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for failure to perform due to force majeure (see section 11), or for any indirect or consequential loss, including loss of profit, data or business opportunity. We are not liable for problems caused by your device, browser or internet connection, or for the content of third-party ads or websites linked from the Site. You use the Site at your own risk. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

11. Force majeure

Neither party is liable for failing to perform its obligations because of events beyond its reasonable control that it could not foresee or avoid (such as natural disasters, pandemics, war, strikes, government actions or carrier disruptions). Such an event suspends the order. If it lasts more than 90 days, either party may cancel the order by written notice, without any compensation, unless we agree otherwise.

12. Intellectual property

All content on the Site (texts, images, videos, graphics, logos, product designs and the Brooke brand) belongs to the Company or is used with its owners' permission, and is protected by copyright and trademark laws. You may not copy, reproduce, distribute or use any part of the Site without our prior written consent. Personal, private use of the Site is permitted. Any unauthorized use may lead to legal action and the closure of your account without notice.

13. Personal data

We collect your data to process and track your orders, to contact you about your orders and our products, and to improve the Site and our Products (including through cookies). Your data is shared only with the service providers who help us run the store, such as payment processors, our fulfillment partner, shipping carriers and our hosting provider Shopify. Full details and your rights are in our Privacy Policy and Cookie & Data Protection Policy. To exercise your rights, email help@drinkbrooke.com.

14. Reviews and feedback

If you send us reviews, ideas, suggestions or other feedback ("Feedback"), whether we asked for it or not, you grant us the right to edit, copy, publish, distribute, translate and otherwise use it, in any medium and without restriction. We are not required to keep Feedback confidential, pay you for it, or respond to it.

We may monitor, edit or remove any content that we consider unlawful, offensive, threatening, defamatory, obscene, or that infringes anyone's rights or these Terms. You agree that your Feedback will not violate anyone's rights (including copyright, trademark, privacy or personality rights), will not contain unlawful, defamatory, offensive or obscene content, and will not contain viruses or malicious code. You agree not to use a false email address, impersonate anyone, or mislead us about the origin of your Feedback. You are solely responsible for your Feedback and its accuracy.

15. Indemnification

You agree to defend, indemnify and hold harmless the Company and its affiliates, officers, directors, employees, agents, contractors, service providers and suppliers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising from your breach of these Terms or your violation of any law or the rights of a third party.

16. Fraud

We reserve the right to cancel any order and take legal action in case of attempted fraud, including the use of a stolen, blocked or counterfeit payment card.

17. Severability and entire agreement

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be separated from the rest of the Terms and will not affect the validity of the remaining provisions. These Terms, together with the policies referenced in them, form the entire agreement between you and us and replace any prior written or oral agreements. You may not assign or transfer these Terms.

18. Governing law and disputes

These Terms are governed by the laws of Switzerland, without prejudice to any mandatory consumer protection laws of your place of residence. Before taking any legal action, please contact us at help@drinkbrooke.com so we can try to resolve the issue informally. Any dispute that cannot be resolved this way will be submitted to the competent courts of the canton of Neuchâtel, Switzerland, unless the law of your place of residence gives you the right to bring proceedings locally.
